Discovery Views Nelson Terms and Conditions

It is important that you read and understand these Terms and Conditions prior to booking. The following Terms and Conditions will apply to your stay at Discovery Views Nelson. We only accept bookings on the Terms and Conditions outlined in this document.

By making a booking and paying a deposit, you agree to abide by and comply with these Terms and Conditions as they stand now and as they may be changed from time to time on our website at discoveryviewsnelson.com.au.

1.1 General

  1. a) It is the guest’s responsibility to read and understand these Terms before making a booking and paying a deposit.
  2. b) By paying the deposit you consent to enter into an agreement to rent the premises in accordance with these Terms.
  3. c) We reserve the right to change all or part of these Terms at any time. It is the guest’s responsibility to keep updated on any changes to these Terms. If you object to a change of the Terms after paying your deposit, it is your responsibility to immediately advise Discovery Views Nelson in writing via the contact details provided on the Website. We agree to negotiate reasonably to produce an outcome acceptable to both parties. Any such negotiation must take place before you occupy the premises.
  4. d) You must monitor the observance of the Terms by your guests and visitors. A breach of these Terms by guests and your visitors will be considered a breach by you.
  5. e) A breach of these Terms can result in but is not limited to, the guest being evicted from the premises and excess charges being applied.
  6. f) Your credit card details will only be used to pay for amounts relating to the booking where incurred and where possible directed by you. This information will never be supplied to a third party by us.
  7. g) If the premises are damaged during your occupancy due to accidental, negligence or wilful act of the guest or the guest’s invitees, the premises will be repaired by us at the cost of the guest. Any malicious damage may result in a report lodged with the police.
  8. h) Use of the premises for any purpose other than as residential holiday accommodation will result in the immediate termination of the booking for the premises unless agreed upon in writing by Discovery Views Nelson. Removal of the guest(s) and other occupants from the premises and other costs or expenses (including a function/extra cleaning fee of up to $1,000) being charged to the guest’s credit card. If insufficient funds are available; the debt will be passed onto a debt collecting company or the courts for the debt plus recovery costs.

1.2 Guests must

  1. a) be at least 18 years of age unless otherwise agreed by Discovery Views Nelson. Photo identification must be presented prior to room access being provided.
  2. b) contain noise at a reasonable level and, in particular, between 10 pm and 8 am.
  3. c) comply with parking regulations and show consideration to neighbours and other vehicles.
  4. d) dispose of garbage and recycling in accordance with the usual practice at the property and in the allocated bins. Guests must not leave excess rubbish in common or public areas and upon departure must place ALL rubbish in external bins ready for council collection. Please remove any excess rubbish that will not fit into the council bins provided.
  5. e) notify us of any complaints as soon as is practicable.
  6. f) minimise their impact on the residential amenity of the neighbours and local community.
  7. g) be responsible for any visitors.
  8. h) observe and abide by any house rules and respect the residential amenities of the property and neighbours.
  9. i) maintain the security, by locking all windows, doors of the premises. Guests will be held responsible for any incident that occurs during their stay or upon departure as a result of the premises being left unsecured.
  10. j) abide by any noise abatement order issued by police or any regulatory authority.
  11. k) refrain from engaging in any drunken, obscene or antisocial behaviour.
  12. l) report any concerns regarding the condition of the property on arrival, advise us as soon as possible.
  13. m) not flush foreign objects down the toilets or you will be liable for costs. Our property operates on a septic system.
  14. n) abide by all laws including local Glenelg Shire laws.

1.3 Information about Discovery Views Nelson

  1. a) While Discovery Views Nelson makes every effort to ensure that this information is current and kept up to date, this information may change without notice. The description of the premises is made in good faith and we will accept no responsibility for any misdescription. All photos on this website were taken on-site and are provided as a guide only.
  2. b) Photographs on the website are an accurate representation of the described property at the time the photograph was taken and are subject to fair wear and tear. Neither Discovery Views Nelson nor the owner of the premises accepts responsibility for personal perceptions. Nor do we take any responsibility for any errors or omissions contained on the website and third-party websites. If any feature/facility is essential for the guest in choosing a particular property, it is advisable that the guest confirms via email or phone at the time of booking. Discovery Views Nelson cannot be held liable for omissions or errors, whether temporary or permanent, regarding the property facilities and services.
  3. c) Discovery Views is privately owned and in the event of faults and/or malfunctions of appliances or inclusions, there is no obligation from the owner to compensate or discount. We will accept no responsibility for any inconvenience with machinery breakdown. In such circumstances, the owner will undertake best endeavours to repair or replace, but being within a small regional town, this is not always possible immediately.
  4. d) We are strictly a Non-smoking facility. It is prohibited to smoke on the property.  Failure to comply will incur a cleaning fee.

1.4 Linen

  1. a) Linen is provided (sheets, pillowcases, towels and bath mats).
  2. b) Linen is required to be used on all beds used throughout your stay, if beds are used without linen additional cleaning fees will apply.

 

2.0 Booking Conditions  

2.1 Tariffs and Fees

  1. a) Tariffs/Prices listed on our website are a nightly rate based upon a minimum stay of the property in accordance with the season. Tariffs, prices/quotations are subject to change without notice and will not be guaranteed until the deposit has been successfully processed by us and you have received formal confirmation of your booking from us via email.
  2. b) Early check-in and/or late check-out is only available if agreed upon prior with Discovery Views Nelson and cannot be guaranteed. Early check-in and late check-out is subject to availability. For example, standard check-in is 2 pm and check-out is 10 am
  3. c) A non-refundable booking fee of $50.00 will apply to all bookings.
  4. d) In the event additional guests are attending a booking Discovery Views Nelson must be informed and the total number must not exceed the property’s advertised capacity.

2.2 Payment and Deposits

  1. a) We accept payment either by credit card (Visa or MasterCard only) or Electronic Funds Transfer. Please note all credit card transactions incur a 2.2% merchant
  2. b) A non-refundable $50.00 booking fee will apply to secure your booking and must be paid at the time of making your booking.
  3. c) For bookings made within 14 days before your arrival date, full payment is required at the time of booking.
  4. d) No matter what the circumstances, the total booking must be paid within 14 days of arrival date.
  5. e) We will endeavour to contact you regarding outstanding balances before the due date, the responsibility to make the payment rests with the guest.
  6. f) If full payment is not received by the due date, the balance will be charged to the credit card supplied at the time of booking (a 2.2% merchant fee applies to all credit card payments).
  7. h) Credit Card details are required for security of the property, to cover damages and additional charges to the property. The guest’s card details (online registration) will be deleted thirty days (30) after departure.

 

3.0 Refunds and Terminating Your Booking

3.1 Termination by guest. We understand plans can change. This is why we highly recommend travel insurance.

  1. a) If you cancel your booking for any reason, you must notify us in writing to info@discoveryviews.com.au.
  2. b) If cancelled more than thirty (30) days before arrival the $50.00 booking fee plus any credit card fees will be forfeited and the balance of the deposit will be returned to the guest.
  3. c) If cancelled between twenty nine (29) to fifteen (15) days before arrival, the deposit and the $50.00 booking fee plus any credit card fees will be forfeited.
  4. d) If cancelled fourteen (14) days or less before arrival, 100% of the total booking cost will be forfeited by the guest.
  5. e) If the total booking cost has not been paid fourteen (14) day before your arrival date, we may terminate the booking with notice to you and seek to re-book the premises. If your booking is terminated under this clause, the guest will automatically forfeit all monies paid.
  6. f) No refund will be given for early departure.
  7. g) Refunds cannot be made for bookings cancelled due to inclement weather or illness. We recommend that you take out comprehensive travel insurance to protect you in this regard.
  8. h) Bookings may be transferred to a future date, provided that the request to transfer by the guest: Is made at least fourteen (14) day before your arrival date, is for a period not later than six (6) months after the original arrival date, the property owner agrees and the applicable tariff for the new date is correctly applied. Where the new dates are at a lower rate, the higher rate will apply. A $45.00 transfer fee will apply. No further amendments, refunds or cancellations are permitted to bookings in this situation.
  9. i) Cash or credit card refunds are not permitted, all refunds will be done via bank transfer. Any bank processing fees inclusive of but not limited to, international transfer fees are charged to the guest.
  10. j) In the event of Government enforced travel restrictions, a non-refundable 12-month voucher for the property booked will be provided to guests. Refunds will not be issued.
  11. k) Bookings cannot be decreased per night after check-in.

3.2 Termination by Agent or Property Owner

  1. a) If the Premises becomes unavailable for occupancy before or during your stay for any reason (i.e. damage to the premises, carrying out emergency repairs, sale of the premises by the owner or any other unforeseen eventuality), we will endeavour to find suitable alternative arrangements for your stay, a transfer fee will not be applicable in this circumstance. If satisfactory alternative arrangements cannot be made, monies paid for the whole or part of the booking not fulfilled will be refunded.

 

4.0 Conditions of Occupancy

4.1 Check-in and Check-Out

  1. a) Check-in time is from 2:00 pm onwards. Room access will be provided to the mobile number provided on the booking.
  2. b) You must check out by 10.00 am on the day of your departure.
  3. c) The property must be returned to its pre-arrival condition and disputes relating to cleanliness, damages, breakages or rubbish removal will not be entered into.

4.2 Use of Premises

  1. a) To maintain a good standard for guests, certain conditions need to be complied with when staying at the Premises. The following conditions apply to all guests:
  • On departure, the premises must be left in a similar state to the condition on arrival. Failure to leave the premises in a satisfactory state will result in you incurring extra charges. You authorise Discovery Views Nelson to charge you for the additional costs incurred to clean the premises on your departure if this condition is not observed. Before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, furniture returned to the original location and crockery and cutlery washed and packed away and barbeque cleaned. The property must be left in a clean and tidy condition.
  • The property should be vacated on time and secured. All windows and doors are to be locked and lights, heating and applicable appliances are switched off.
  • If a barbeque clean is required after departure, a $60 cleaning fee will apply.
  • Only the number of people shown on the confirmation email may stay at the premises overnight. The number of your guests at any time should not exceed the number stated on the confirmation email notice unless previously agreed in writing by email with Discovery Views Nelson.
  • You must not use the premises for any unlawful purpose.
  • You must not smoke on the premises.
  • Parties and other functions are strictly prohibited on the premises. The total booking fee charged is for private domestic holiday use only. Accordingly, this rate does not allow for the extra costs associated with functions in terms of cleaning, garbage removal, wear and tear, repairs etc. Failure to comply with this condition may be considered a serious breach of this agreement resulting in your eviction and the loss of all monies paid by you.
  • Disturbance to neighbours, including excessive noise is strictly prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses. Please note you are in a residential area and regard must be paid to the quiet enjoyment of neighbouring properties.
  • If during your occupancy as an in-house guest, you notice the failure of services, breakages or damage to the property you must request (by telephone, email or SMS) maintenance to fix/rectify the matter. The guest authorises Discovery Views Nelson or a representative to enter the premises to assess what is required and to carry out the required works. Discovery Views Nelson will endeavour to work with all parties to find a suitable time to enter the property. If work is urgent, Discovery Views Nelson or a representative has the authority to enter.
  • Guests are not permitted to erect swimming pools on the premises.

4.3 Pets

  1. a) Prior arrangement is required to have pets. All pets must be listed on the booking.
  2. b) Pets must be kept outside at all times unless the condition of the property states otherwise. Failure to clean up after your pet may result in additional cleaning charges.
  3. c) Pets must not be left unattended at the property.
  4. d) All damages by the pet are the responsibility of the guest, including but not limited to flooring, carpets, furniture, woodwork, gardens, plants, fences and lawns.
  5. e) All pet waste must be removed at the end of the stay.
  6. f) The owner does not accept responsibility for any harm to the animals or other parties resulting from the pet being admitted to the premises.
  7. g) From the 1st of July 2023 cats must be kept in accordance with the local containment laws.

4.4 Breach of Conditions of Occupancy

A failure to comply with any of these conditions may be considered a serious breach of this agreement resulting in your eviction, and the loss of monies paid (or owed) by you. A $110 administration fee will also be processed for major claims.

4.5 Parking

Guests must park their cars in an appropriate manner as not to inconvenience other guests and only in the designated parking areas and clear of driveways. Do not park on grass areas. Do not park on nature strips of neighbouring properties.

4.8 Loss, damage or injury

If on arrival you notice any existing damage or breakages within the premises you must report your concerns regarding the condition of the property to us as soon as possible after your arrival. Otherwise, it is agreed that all is in order with the premises.

You will be held responsible for any damage, breakages, theft or loss of any property on or in the premises during your stay. If any property is affected in this manner, you will be responsible for all related costs for the repair or replacement of the affected property. You authorise us to deduct these from your credit card accordingly or pay via bank transfer. A $110 administration fee will be processed on top of all major claims.

Discovery Views Nelson nor the owner of the premises takes any responsibility for the loss or theft of your personal property or for any bodily injury that occurs on or at the premises. We recommend all guests purchase travel insurance and Discovery Views Nelson holds no responsibility for any injuries, illness or accidents that may occur whilst staying at the property.

4.9 Parties and other entertaining

We have a zero policy on parties being held on the premises. A party is defined as:

  • Any situation where the maximum number of guests on the premises is more than the permitted number of guests, and/or
  • Any situation where the noise level from the premises is deemed too high thereby disturbing other guests and/or residents, and/or
  • Any situation whereby excessive traffic to and from the premises is identified, and/or
  • Any situation where it is deemed that intoxication is occurring.

If any accommodation is identified as having a party, we reserve the right to immediately request all occupants of the premises to vacate the premises and terminate the stay. In such a situation, the total booking fee will be forfeited. In addition, any expense resulting from additional cleaning, replacement of any furniture/fixture/breakages, as well as any repairs, you authorise us to deduct these from your credit card accordingly or pay via bank transfer. A $110 administration fee will be processed on top of all major claims.

We do not permit any schoolies, hens and stag nights or other gatherings at our property.

4.10 Additional actions that may result in eviction.

Discovery Views Nelson, or our appointed security provider reserve the right to immediately evict any guest, visitor or member of the public for the following (but not limited to) reasons:-

  • Intoxication and/or unsavoury/lewd behaviour; or
  • Throwing objects off the premises; or
  • Spitting or vomiting; or
  • Wilful damage to the premises or to surrounding property; or
  • Physical or verbal abuse/assault of our staff, other guests, residents, members of the public on or around the premises; or
  • Any behaviour deemed as a potential safety threat to others; or
  • Any breach of these terms and conditions including party policy; or
  • Any incident for which our appointed security contractor or police are required to attend.
  • Excessive noise at the premises

5.0 Extra Fees and Charges

In addition to the tariffs and fees listed above being paid in full before you enter the premises, additional fees and charges may be levied as outlined below:

  • The guest’s credit card details will be held as security against the property.
  • By agreeing to the Terms, you provide your consent for us to deduct from your credit card any additional fees or charges stipulated in this agreement; examples of this include but are not limited to any breakage, damage or excess cleaning requirements. A $110 administration fee will also be processed on top of all major claims.
  • You must pay all associated costs for the repair or replacement of damaged, lost or stolen property on or at the premises.
  • Should a guest request any lost property to be posted after departure, this will be sent via Australia Post at cost plus an administration fee of $20.00 plus any insurance costs if the guest requests it.
  • We reserve the right to charge you an additional cleaning fee to cover the reasonable cost of additional cleaning of the premises that is required as a result of your occupancy.
  • Extra cleaning charges will be incurred for the cleaning of dirty dishes, emptying the fridge, moving furniture back to its original location, removal of rubbish, and excessively smeared glass (this will include mirrors, glass feature walls and glass sliding doors) and excessive drink spills on the floor. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be charged to your credit card. These fees are in addition to any damage outlined in 1.1(g) above. A $110.00 administration fee will also be processed on top of all major claims.
  • If a guest locks themselves out of the property and we are required to attend the premises to open the property a $55.00 surcharge call-out fee may apply or $110.00 outside of normal hours (weekends and public holidays and after 5pm and before 8 am weekdays).

 

6.0 Problems and Complaints

In the event of a problem or complaint you must inform Discovery Views Nelson immediately and during your stay so that management has the opportunity to rectify the situation as quickly and efficiently as possible within a reasonable timeframe. Failure to follow this procedure may hinder the ability to rectify the problem or complaint and will extinguish any claim for compensation.

7.0 Interpretation

All dollar amounts on the website are expressed in Australian dollars (AUD$) only. Overseas guests need to consider changes in exchange rates and any impact that may arise as a consequence of making the booking.

“Guest” means any person residing overnight on the premises and permitted under the same booking.

‘Total Booking Fee” means the total rate or amount payable for the full period of your stay including the basic tariff plus (if levied) bond; and administration, credit card reprocessing fees, and any other fees as outlined in these Terms.

“Website” means the information portal at discoveryviewsnelson.com.au or other third party platforms.

“You” means any person residing overnight on the premises and permitted under the same booking.
